1. Description of Service

Blockema is a data validation service for Excel and CSV files, operated from Barcelona, Spain. The service allows you to validate your data against custom rules to ensure accuracy and consistency before analysis, migration, or integration.

You must be at least 18 years old and legally capable of entering into a binding contract to use Blockema. By using the service, you confirm that you meet these requirements.

To access subscription features, you must create an account using your email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate and complete information when creating your account and to keep it up to date.

Subject to these Terms, Blockema grants you a limited, non-exclusive, non-transferable, revocable license to use the service for your internal business or personal purposes. This license does not include the right to:

5. Subscription and Payment

5.1 Plans

Blockema offers a monthly subscription plan priced at €19 per month (or the equivalent in your local currency at the time of purchase).

5.2 Payment Provider

Payments are processed by Polar.sh. By subscribing, you agree to Polar.sh's terms of service and privacy policy in addition to these Terms. Blockema does not store your credit card or payment details directly.

5.3 Billing

Subscriptions are billed monthly in advance. You authorize recurring charges to your payment method until you cancel.

5.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing period, except as required by applicable law.

6. Free Trial

New users receive 3 free file validations to evaluate the service. The free trial requires no payment information and expires 30 days after your first validation or when all 3 validations are used, whichever comes first. Blockema reserves the right to modify or discontinue the free trial at any time.

7. Your Data

7.1 Browser-Based Validation

When you use browser-based validation, your files never leave your device. No file data is transmitted to or stored on our servers.

7.2 Server-Based Validation

When you use server-based validation, your files are uploaded to our servers for processing. Uploaded files and any derived results are permanently deleted within 24 hours of processing. We do not use your file data to train models, for advertising, or for any purpose other than providing the validation service you requested.

7.3 Account Data

We store your account information (email address, usage history, and validation settings) to provide and improve the service. You may request deletion of your account data at any time by contacting hello@blockema.com.

8. Intellectual Property

All rights, title, and interest in and to the service, including software, design, text, graphics, logos, and documentation, are the exclusive property of Blockema. Nothing in these Terms transfers ownership of any intellectual property to you.

The service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Blockema does not warrant that the service will be uninterrupted, error-free, or secure, or that validation results will be complete or accurate. You are solely responsible for verifying the accuracy and completeness of your data.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Blockema shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or business opportunities, arising out of or related to your use of the service.

Blockema's total aggregate liability for any claim arising from or related to these Terms or the service shall not exceed the amount you paid to Blockema in the twelve (12) months preceding the claim.

12. Termination

You may terminate your account at any time by contacting hello@blockema.com or through your account settings.

Blockema may suspend or terminate your access to the service immediately, without prior notice, if you breach these Terms or engage in conduct that Blockema reasonably determines to be harmful to other users, the service, or third parties.

Upon termination, your right to use the service ceases immediately. Sections that by their nature should survive termination will survive, including Sections 7, 8, 10, 11, and 14.

13. Changes to These Terms

Blockema reserves the right to modify these Terms at any time. Material changes will be communicated by email or by posting a notice on the service at least 30 days before they take effect. Your continued use of the service after the effective date constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the service and cancel your subscription.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Spain.

14.2 Jurisdiction

Any disputes arising out of or relating to these Terms or the service shall be submitted to the competent courts of Barcelona, Spain, to the extent permitted by applicable law.

14.3 EU Consumer Rights

If you are a consumer residing in the European Union, you may also be entitled to use the European Online Dispute Resolution (ODR) platform, accessible at https://ec.europa.eu/consumers/odr, to resolve disputes arising from online purchases or services.

14.4 Applicable Consumer Protection

Pursuant to Real Decreto Legislativo 1/2007, of November 16, which approves the revised text of the General Law for the Defence of Consumers and Users (Ley General para la Defensa de los Consumidores y Usuarios), you have the right to withdraw from any distance contract within 14 calendar days from the date of subscription, without providing any reason. To exercise this right, you must notify Blockema by email at hello@blockema.com with an unambiguous statement of your decision to withdraw. You may use the model withdrawal form provided by Spanish regulations, though it is not mandatory. If you exercise your right of withdrawal, Blockema will refund all payments received without undue delay and in any event not later than 14 days from the date on which Blockema is informed of your decision to withdraw. Refunds will be made using the same payment method used for the initial transaction, unless otherwise agreed.
